HOA Dues are payable on an annual basis and are due January 1 of each year. If payment has not been received by the Managing Agent by January 31, a late fee of $50 will be assessed to the homeowner. If unpaid dues remain at the end of subsequent months, an additional $50 late fee will be imposed per month.

Any homeowner with a prior balance from the previous year will have payments applied first to that prior balance, then to the annual dues.

Dues and late fees not paid by March 31 are subject to collection through legal action of the Board of Directors. Prior to the commencement of legal action including the filing of a lien against the homeowner’s property for non-payment of dues, the Board will have its Managing Agent send reminder letters to the homeowner in arrears, advising that the account is past due and requesting prompt payment. The Board reserves the right to file a lien and commence litigation in the Town of Somers Justice Court to collect any outstanding arrears as well as to recover the cost of litigation including any court and attorneys’ fees incurred.
